These Terms and Conditions govern your use of services provided by Somatic Earth, a sole trader business operating in South Yorkshire, United Kingdom. By booking any service, ceremony, or experience with Somatic Earth, you agree to be bound by these Terms and Conditions.
1. SERVICES PROVIDED
Somatic Earth offers creative healing experiences including but not limited to: - Birth Your Branding Ceremony (group online experience) - One-to-one healing journeys - Group ceremonies and creative offerings - Somatic movement, meditation, breathwork and creative practices All services are delivered online via Zoom unless otherwise stated.
2. BOOKING AND PAYMENT
2.1 Payment Methods We accept payment via: - Stripe - Eventbrite (for ticketed events such as the Birth Your Branding Ceremony) 2.2 Payment Plans Payment plans may be available for certain services on a case-by-case basis. Please contact us directly to discuss payment plan options. 2.3 Full Payment Unless a payment plan has been agreed in writing, full payment is required at the time of booking to secure your place. 2.4 Prices All prices are listed in GBP (£) and include VAT where applicable. Prices are subject to change but any changes will not affect bookings already confirmed.
3. CANCELLATIONS AND REFUNDS
3.1 Cancellations by You (Client) For One-to-One Healing Journeys: Cancellations made 7 days or more before your scheduled session are eligible for a full refund. Cancellations made less than 7 days before your session may be eligible for rescheduling, subject to availability. If you fail to attend your scheduled session without prior notice, no refund or rescheduling will be offered For Group Ceremonies and Events (including Birth Your Branding Ceremony): Cancellations made 7 days or more before the event date are eligible for a full refund.Cancellations made less than 7 days before the event are not eligible for refund or rescheduling due to the nature of group work - If you are unable to attend, your place cannot be transferred to another person or event
3.2 Cancellations by Somatic Earth In the unlikely event that I need to cancel or reschedule a session or ceremony due to emergency circumstances: - You will be notified as soon as possible with as much advance notice as can be given - You will be offered the option to reschedule to an alternative date that suits both parties - If rescheduling is not possible or suitable for you, you will receive a full refund.
4. TECHNICAL REQUIREMENTS
4.1 Online Sessions All sessions are conducted online via Zoom. By booking, you confirm that you have: A reliable internet connection, Access to a device with camera and microphone capabilities, A Zoom account (free accounts are acceptable), Access to email for session links and communication.
4.2 Additional Platforms Some creative sessions may require access to: - Pinterest (for visual inspiration and moodboarding) - Miro (for collaborative creative work) You will be notified in advance if account creation is needed for these platforms. These are free to use.
4.3 Technical Issues While I will do my best to ensure smooth delivery of all online sessions, I cannot be held responsible for technical issues outside of my control including but not limited to: internet connection problems, platform outages, or device malfunctions on your end.
5. INTELLECTUAL PROPERTY
5.1 Your Work All creative work, branding, logos, designs, and materials you create during our sessions belong to you. You retain full ownership and intellectual property rights to anything you produce.
5.2 My Materials All guided meditations, session structures, teaching materials, and methodologies used during our work together remain the intellectual property of Somatic Earth and may not be reproduced, distributed, or taught without written permission.
5.3 Use of Images and Testimonials By participating in sessions, you grant Somatic Earth permission to: Take screenshots during online sessions, Request photographs of your creative work, Request written testimonials about your experience. These may be used for marketing purposes including on the website, social media, and promotional materials. Your full name will only be used with your explicit written consent. If you do not wish for any images or testimonials to be used, please notify me in writing at any time.
6. RECORDINGS 6.1 Session Recordings Some sessions may be recorded for your personal reference and learning. You will always be notified before a recording begins.
6.2 Your Use of Recordings If a recording is provided to you, it is for your personal use only and may not be shared, distributed, or reproduced without written permission.
6.3 Opting Out If you do not wish for a session to be recorded, please let me know before the session begins.
7. HEALTH AND SAFETY DISCLAIMERS
7.1 Medical Disclaimer The services provided by Somatic Earth, including somatic movement, breathwork, meditation, and healing practices, are not a substitute for medical or mental health treatment. By booking, you confirm that: You are physically and mentally able to participate in movement and breathwork practices. You will inform me of any medical conditions, injuries, or mental health concerns that may affect your ability to participate safely. You will take responsibility for your own wellbeing during sessions and stop any practice that feels uncomfortable or unsafe. You understand that I am not a licensed medical professional, therapist, or counsellor
7.2 Physical Activity Somatic movement practices may involve physical activity. You are responsible for ensuring you have adequate space, appropriate clothing, and a safe environment for movement. If you have any injuries, physical limitations, or health conditions, please inform me before the session so we can adapt practices accordingly.
7.3 Emotional Processing The work we do together may bring up emotions, memories, or sensations. This is a normal part of the healing process. However, if you are currently in crisis, experiencing severe mental health symptoms, or under the care of a mental health professional for acute conditions, please consult with them before booking. If you need additional support outside of our sessions, I encourage you to reach out to appropriate professional services.
7.4 Breathwork Disclaimer Breathwork is not suitable for everyone. Please do not participate in breathwork practices if you: Are pregnant. Have a history of cardiovascular issues, including high blood pressure. Have been diagnosed with epilepsy or seizures. Have severe mental health conditions including psychosis or bipolar disorder (unless cleared by your healthcare provider). Have recently had surgery or have physical injuries that may be affected by deep breathing. If you have any concerns about whether breathwork is safe for you, please consult your doctor before participating.
8. CONFIDENTIALITY AND PRIVACY
8.1 Your Privacy Everything you share during our sessions is kept confidential unless: You give explicit permission for me to share (e.g., testimonials). I am legally required to disclose information (e.g., safeguarding concerns).
8.2 Data Protection Your personal information is handled in accordance with UK GDPR and our Privacy Policy. Please refer to our Privacy Policy for full details on how your data is collected, stored, and used.
8.3 Group Sessions Please note that in group ceremonies and sessions, other participants will be present. While I ask all participants to respect confidentiality, I cannot guarantee the privacy of what is shared in group settings.
9. CODE OF CONDUCT
9.1 Respectful Behaviour All participants are expected to: Treat me and other participants (in group settings) with respect and kindness. Arrive on time for scheduled sessions. Come prepared with any materials or information requested in advance. Engage with the work in good faith
9.2 Right to Refuse Service I reserve the right to refuse service or terminate our working relationship if: You behave in a disrespectful, abusive, or inappropriate manner. You repeatedly miss sessions without notice. You violate these Terms and Conditions In such cases, no refund will be provided for services already rendered.
10. LIABILITY
10.1 Limitation of Liability To the fullest extent permitted by law, Somatic Earth shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
10.2 Professional Insurance Somatic Earth holds professional indemnity insurance for the services provided.
10.3 Your Responsibility You are responsible for your own wellbeing during and after sessions. This includes: Creating a safe physical space for online sessions. Monitoring your own physical and emotional state. Seeking additional professional support if needed. Following any aftercare guidance provided
11. FORCE MAJEURE Neither party shall be held liable for any failure or delay in performing obligations under these Terms due to circumstances beyond reasonable control, including but not limited to: acts of God, natural disasters, war, pandemic, government restrictions, or technical failures of third-party platforms.
12. AMENDMENTS TO TERMS
I reserve the right to update these Terms and Conditions at any time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of services after changes are posted constitutes acceptance of the updated Terms.
13. GOVERNING LAW These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
